Neutral Citation No. - 2025:AHC-LKO:41167-DB Court No. - 1 Case :- CRIMINAL MISC. WRIT PETITION No. - 6158 of 2025 Petitioner :- Ashish Kumar Srivastava Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. And Others Counsel for Petitioner :- Durgesh Kumar Shukla,Basant Pandey Counsel for Respondent :- G.A. Hon'ble Attau Rahman Masoodi,J. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the petitioner and learned A.G.A. for the State. Under challenge in this writ petition is the First Information Report No.21 of 2025 dated 08.02.2025 lodged by the opposite party no.4 at Police Station Tarun, District Ayodhya under Sections 314, 316(5), 318(4), 336(3) B.N.S. On a plain reading of the F.I.R. impugned in this writ petition, it cannot be said that a cognizable offence is not made out. The allegations levelled in the F.I.R. are specific to the effectg that the attendance recorded and maintained by the institution was not a truthful document contrary to which the attendance of those trainees was found short rather the institution was found closed on the said date for which there was a mark on attendance register. The writ petition for quashing of F.I.R. is thus not maintainable and deserves rejection. The writ petition is accordingly rejected without prejudice to legal remedy of anticipatory bail/regular bail available to the petitioner before the competent authority.
