The instant application under section 483 Cr.P.C./529 of the B.N.S.S.,2023 has been filed with the prayer to direct the learned trial court i.e. the learned Chief Judicial Magistrate Gonda to decide the Case No. 460/2023 (State Versus Noman Ali & Others) arising out of Case Crime No. 299/2023, Under section-498-A, 323, 504, 506 of the Indian Penal Code & sections of the Muslim Women (Protection of Rights on Marriage) Act, 2019 & Sections of the Dowry Prohibition Act pertaining to Police Station- Khargupur, District- Gonda, pending before him since 22.11.2023 expeditiously, within stipulated time prescribed by this Hon'ble Court, in the interest of justice. Learned counsel appearing for the applicant submits that the matter pertains to the year 2023 and even after passing of about 2 years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the trial court is directed to consider and decide the Case No. 460 of 2023, with expedition, in accordance with law considering the instructions and guidelines issued by this court; time to time. With the aforesaid observation, the instant application stands disposed of.
