HIGH COURT OF TRIPURA AGARTALA IA No.1 of 2025 In BA No.100 of 2025(D/O) Sri Mithun Choudhury ---Applicant(s) Versus The State of Tripura ----Respondent(s) For Applicant(s) : Mr. Hare Krishna Bhowmik, Adv. For Respondent(s) : Mr. Raju Datta, P.P. HON’BLE MR. JUSTICE BISWAJIT PALIT Order 13/11/2025 This application is filed for relaxation of the condition of bail granted by this Court vide order dated 27.10.2025 in connection with BA No.100 of 2025. Heard Learned Counsel Mr. H. K. Bhowmik appearing on behalf of the applicant and also heard Learned P.P. Mr. R. Datta appearing on behalf of the State. At the time of hearing Learned Counsel appearing for the accused-applicant submitted that by order dated 27.10.2025 the accused was granted bail with certain conditions and accordingly he is complying with the directions given by this Court and appearing before I.O. once in a week i.e. on every Wednesday but by this time the said accused is to attend his office at District Drug Store (TB), Dhalai Tripura for which it has become difficult on his part to attend I.O. on every Wednesday, and it was further submitted that by the said order a direction was given to leave the station subject to the permission of the O.C. of the concerned P.S. and accordingly he approached to the O.C. of the concerned P.S. seeking permission to leave the station but in absence of any specific order the O.C. did not allow his contention and as such the situation compelled him to approach this Court for modification of the order. Learned P.P. on the other hand submitted that the investigation of the case is in progress. However the conditions may be modified to some extent so that the investigation of the case is not hampered. So after hearing both the sides it appears to this Court that if the conditions is not modified it would be inconvenient for the accused-applicant to comply with the direction of the Court and accordingly it is ordered that the accused shall attend I.O. on every Sunday instead of Wednesday till filing of chargesheet and he is permitted to leave the station to attend his office but before leaving the station he shall furnish his mobile number and contact number of his official superior to I.O. for the sake of investigation. With this observation, this IA stands disposed of. However, the liberty is given to the applicant to approach to the concerned Trial Court for further modification of the order if the situation so demands. A copy of this order be furnished to Learned Counsel appearing for the applicant for information and compliance and also a copy of this order be communicated to the I.O. through Learned P.P.
