A perusal of the material on record will indicate that the petitioner was granted bail in Crl.P.No.5644/2024 vide order dated 24.07.2024. In the said order, bail condition No.2 reads as under: “2. The petitioner shall appear before the concerned I.O. within 15 days from the date of this order without fail.” 3. As per the said condition, petitioner was required to appear before the concerned Investigating Officer within a period of fifteen days from the said order. The petitioner having failed to appear before the Investigating Officer, subsequently, filed application seeking extension, which was granted and again, petitioner filed one more application, which was dismissed by the - 3 - NC: 2025:KHC:7813 CRL.P No. 1307 of 2025 Trial Court vide impugned order, which is assailed by the petitioner in the present petition. 4. Learned counsel for the petitioner submits that petitioner would comply with the aforesaid condition No.2 and appear before the Investigating Officer on 10.03.2025 along with relevant documents and impugned order may be set aside by imposing certain directions upon the petitioner. 5. In view of the submission made by learned counsel for the petitioner that he would appear before the Investigating Officer on 10.03.2025 along with the relevant documents, I deem it just and appropriate to set aside the impugned order and allow the Crl.Misc.No.8474/2024 by imposing certain directions upon the petitioner. 6. In the result, I pass the following: ORDER i) The petition is hereby allowed. ii) The impugned order dated 01.10.2024 passed in Cri.Misc.No.8474/2024 on the file of LXVIII - 4 - NC: 2025:KHC:7813 CRL.P No. 1307 of 2025 Additional City Civil and Sessions Judge, Bengaluru City is hereby set aside. iii) Cri.Misc.8474/2024 is allowed by directing the petitioner to appear before the Investigating Officer on 10.03.2025 along with relevant documents.
