Service of notice upon respondent no.2 is sufficient considering the order dated 14.08.2025 as also considering the Annexure No. CA-1 of Counter Affidavit filed by the State with a proof of service of notice upon respondent no. 3, this Court finds that service of notice upon the respondent no. 3 is also sufficient. However, no one appeared on behalf of the respondent nos. 2 and 3 to oppose the present appeal. In this view of the matter, this Court proceeded to hear the instant appeal. 3. Heard learned counsel for the appellant and learned A.G.A. for the State- respondent. 4. On 22.02.2024 the non-bailable warrant was issued and on coming to know about the aforesaid fact the appellant appeared before the trial Court and moved an application for recall of order dated 22.02.2024 whereby the non-bailable warrant was issued, however, the trial Court Versus Counsel for Appellant(s) : Dharmendra Kumar Counsel for Respondent(s) : G.A. Zilajeet Prajapati .....Appellant(s) State Of U.P. Thru. Secy. Home Deptt. Lko. And 2 Others .....Respondent(s) rejected the application and took the appellant into custody. 7. It is stated that appellant would remain present on the date fixed and he would not misuse the liberty granted by the court and due to some unavoidable reasons he could not appear on the dates fixed. 8. Thus, indulgence of this Court is required in the matter. 12. Learned A.G.A. opposed the prayer of the appellant, however, he could not dispute the above contentions made by the appellant's counsel. 13.
