Neutral Citation No. - 2025:AHC-LKO:39928 Court No. - 5 Case :- WRIT - A No. - 7506 of 2025 Petitioner :- Indramani Pandey Respondent :- State Of U.P. Thru. Addl. Chief Secy. Kriashi Shiksha Evam Anusandhan Vibhag Lko. And 3 Others Counsel for Petitioner :- Rakesh Chandra Tewari,Yogendra Pratap Singh Counsel for Respondent :- C.S.C.,Ran Vijay Singh Hon'ble Abdul Moin,J.
1. Heard learned counsel for the petitioner, learned Standing Counsel appearing for the respondent no.1 and Sri Ran Vijay Singh, learned counsel appearing for respondents no.2 to 4.
2. With the consent of learned counsels for the parties, the writ petition is being decided finally.
3. The contention of learned counsel for the petitioner is that despite the petitioner's father having died on 07.08.2019 while working on the post of Assistant Professor the petitioner's claim for compassionate appointment has still not been considered although the respondents vide their order dated 11.07.2024, a copy of which is Annexure-9 to the petition, had required the petitioner to submit various details in order to process the claim for compassionate appointment. It is thus contended that there cannot be any occasion for keeping the claim of the petitioner for compassionate appointment pending and on the other hand having appointed other persons whose claims for compassionate appointment have already been processed.
4. Considering the aforesaid, the writ petition is disposed of with a direction to respondent no.3 to consider the claim of the petitioner for compassionate appointment in accordance with law and rules provided there is no legal impediment. Let such
consideration be done within a period of eight weeks from the date of receipt of a certified copy of this order.
5. It is made clear that this Court has not gone into the merits of the case.
