For Respondent(s) : Ms. Arti Sharma, Dy.GA HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 05/05/2025 1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the order dated 02.04.2025 passed by learned Additional Sessions Judge No.02, Jhunjhunu (Raj.) in connection with FIR No.86/2025, registered at Police Station Gudhagaurji, District Jhunjhunu for the offences punishable under Sections 189(2), 115(2), 126(2), 109(1) and 324(3) of BNS, 2023(later on Sections 191(2), 190, 109(1), 115(2), 126(2), 324(3), 61(2) of BNS), by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed. 2. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Though, the case has been registered under Section 109(1) of BNS also, however, only one simple injury by blunt weapon was [2025:RJ-JP:18768] (2 of 3) [CRLMB-4951/2025] found on the forhead of injured-Vinod Kumar. Learned counsel argues that the accused-applicant is behind the bars since long. Learned counsel contends that no specific allegation has been levelled against the accused-applicant. Learned counsel also contends that no other criminal case has been registered against the accused-applicant. Learned counsel prays that the investigation and trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail. 3. On the other hand, learned Public Prosecutor opposes the bail application. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the fact that no specific injury has been attributed to the accused-applicant and considering the fact that injury found on the body of the injured has been caused by blunt weapon and simple in nature and also considering the fact that the accused- applicant is behind the bars since long as well as considering the fact that trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant. 6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Roshan Lal S/o Tejpal, arrested in FIR No.86/2025, registered at Police Station Gudhagaurji, District Jhunjhunu shall be released on bail; provided he furnishes personal bond in the sum of [2025:RJ-JP:18768] (3 of 3) [CRLMB-4951/2025] Rs.50,000/- and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. 7.
