Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Jamtara Cyber Crime PS Case No. 26 of 2025, registered for the offence under Sections 111(2)(ii), 317(2), 317(4), 318(4), 319(2), 336(3), 338, 340(2), 3(5) B. N.S., 2023 and under Sections 66B, 66C, 66D of I.T Act.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has been falsely implicated in this case. It has been submitted that the there is absolutely no evidence against the petitioner with regard to the commission of Cyber offence. It is submitted that no illegal transaction has been found from the recovered mobile phones nor a single transaction has been proved to be illegal by substantiating any cogent evidence and as such the petitioner could not be made an accused on presumption. Learned counsel submits that the petitioner is in custody since 03.04.2025 as such he may be enlarged on bail.

Learned APP opposes the prayer for bail.

Having regard to the aforesaid facts and circumstances of

the case, I am inclined to enlarge the petitioner on bail and accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J- 1st, Jamtara, in connection with Jamtara Cyber Crime PS Case No. 26 of
2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall cooperate in trial and if any adverse report will come against this petitioner, learned trial Court shall be at liberty to cancel the bail of this petitioner.
