HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CIVIL MISC REVIEW APPLICATION DEFECTIVE No. - 148 of 2023 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE MANISH KUMAR, J. (CMA/1/2023) This is an application seeking condonation of delay in filing the review application. Heard. Cause shown in the affidavit filed in support of the application for the condonation of delay is sufficient. Accordingly, the application is allowed. Delay in filing the review application is condoned. (Order on review application) We have heard learned counsel for the parties and perused the record. We have dismissed the writ petition bearing Writ-C No.4323 of 2023 on the ground that limitation for raising a claim under Mukhyamantri Krishak Durghatna Kalyan Yojna expired in this case prior to the date from which the limitation was extended during covid period by Hon'ble the Supreme Court in Suo Motu Writ Petition (Civil) No.3 of 2020 and following it by this Court in Writ-C No.1591 of 2022; Pushpa vs. State Versus Counsel for Applicant(s) : Dilip Kumar Mishra Counsel for Opposite Party(s) :
Janak Lali .....Applicant(s) State Of U.P. Thru.Prin.Secy. Revenue Deptt. Civil Secrt. Lko. And Others .....Opposite Party(s)
U.P. However, today we find that a government order was issued prior to dismissal of the writ petition i.e. on 19.08.2020, according to which, if any death had occurred between 14.09.2019 to 31.07.2020, then, limitation for raising a claim under the aforesaid scheme would be extended by 75 days, which, in this case, would end on 01.11.2020 and prior to it the order of Hon'ble the Supreme Court in Suo Motu Writ Petition No. 3 of 2020 had been passed and in view of Division Bench judgement passed in the case of Pushpa (Supra) the time stood extended from 15th March, 2020 till 28.02.2022, therefore the application of the petitioner on 9.2.2021 was within time. These facts could not be brought to the notice of this Court. In view of what has been stated above, the order is apparently erroneous, therefore, we recall our order dated 31.05.2023. Consequently, the writ petition i.e. Writ-C No.4323 of 2023 stands restored. List the writ petition before the appropriate Court in the next week. The review petition stands allowed.
