[2025:RJ-JP:32604] (2 of 3) [CRLMB-4988/2025] testimony of injured as well as doctor who examined the injured. Now, both the aforementioned witnesses have been examined during the course of trial thus, this second bail application has been preferred. 3. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that co-accused namely Devendra @ Doctor and Lokesh have already been granted benefit of bail by this Court vide order dated 28.01.2025. Counsel submits that till date, only three witnesses have been examined out of twenty one cited prosecution witnesses thus, there is bleak chance of culmination of trial in near future. Counsel contends that petitioner is in custody since 26.09.2024 and further custody of the petitioner would not serve any fruitful purpose. 4. Per contra, learned Public Prosecutor opposes the bail application. He submits that it is a serious matter as petitioner caused repeated blow on the chest of the injured by knife and same has been corroborated by the Medical Expert who found two injuries on the chest of the injured and both the injuries have been opined as dangerous to life.
He submits that another injury was found on the right arm of the injured which is a long wound measuring around 23 cm. He further submits that three other cases have been registered against the petitioner. 5. I have considered the contentions. 6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by both the parties, especially considering the fact that there is allegation
[2025:RJ-JP:32604] (3 of 3) [CRLMB-4988/2025] against the petitioner of causing repeated blow on the chest of the injured by sharp edged weapon, as also looking to the nature of injuries and criminal antecedents against the petitioner, this court is not inclined to enlarge the petitioner on bail. 7. Accordingly, this second bail application stands dismissed. 8. The observations made hereinabove are only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /103
