KAMAL ORAL ORDER Learned counsel for the petitioner submits that the petitioner is before this court seeking quash of preliminary notification dated 04.01.2007 issued under Section 17 of Karnataka Urban Development Act, 1987, to the extent of property measuring 26 guntas in land bearing Sy.No.1/4 of Chowdahalli village, Kasaba Hobli, Mysuru Taluka and District. That even after lapse of 17 years of the preliminary notification, the respondent authorities have not taken forward the acquisition process and no final notification has been issued. 2. Learned counsel for the petitioner relying upon the order passed by the co-ordinate Bench of this Court in WP Nos.47459-461/2018 disposed of on 26.06.2019 and - 3 - NC: 2025:KHC:7393 WP No. 3069 of 2025 followed in another order by the co-ordinate Bench in WP No.19230/2021 dated 23.11.2021, submits that the petition may be disposed of on similar lines. 3. Learned counsel for the respondents does not dispute the aforesaid factual and legal aspect of the matter, accordingly, the following. ORDER (i) Writ petition is allowed. (ii) The preliminary notification dated 04.01.2007 passed by the 2nd respondent authority as per Annexure- A is hereby quashed to the extent of the property bearing Survey No.1/4 measuring 26 Guntas, situated at Chowdahalli Village, Kasaba Hobli, Mysuru Taluk and District, belonging to the petitioner.
