This is an application filed by the respondent seeking release of amount of Rs. 75,000/- along with interest in his favour. 2. In the application, it has been submitted that the appellant/non- applicant had filed the appeal against the judgment dated 24th March 2016 passed by the learned District Judge Pulwama whereby suit of the applicant/plaintiff for recovery against the non-applicant/defendant was decreed and he was held entitled to recover an amount of Rs. 2.65 lacs along with costs and interest. It has been submitted that the said judgment/decree of the trial court has been upheld by this Court in terms of judgment dated 29.07.2025. 3. It has been submitted that at the time of the admission of the appeal, the impugned judgment/decree passed by the learned trial P a g e | 2 CM(2431/2026) IN CFA 64/2016 court was stayed subject to deposition of Rs. 75,000/- by the appellant/non-applicant pursuant whereto the amount has been deposited. 4. Having regard to the fact that the appellant/respondent has succeeded in the appeal inasmuch as the appeal has been dismissed and the judgment of the trial court has been upheld, the Registry is directed to release the deposited amount of Rs. 75,000/- along with interest that may have accrued thereon in favour of the applicant/plaintiff. The amount shall be transferred to the bank account of applicant/plaintiff particulars whereof shall be furnished by him to the Registry. 5. CM disposed of.
