2. The present revision application has been filed for grant of bail by setting aside order dated 15.04.2025 passed by learned Additional Sessions Judge-I-cum-Special Judge, Children Court Latehar in Criminal Appeal No.17/2025 whereby the appeal preferred against the
order of rejection of bail passed by learned Juvenile Justice Board, Latehar dated 27.02.2025 has been affirmed and the prayer for bail of the juvenile petitioner has been rejected in connection with Latehar P.S. Case No.21/2025, Special POCSO Case No.16/2025 corresponding to Juvenile Case No.05/2025 under Sections 96 & 3(5) of the B.N.S. and 8 and 12 of POCSO Act passed by the Court of learned Principal Magistrate, Juvenile Justice Board, Latehar. 3. The brief facts of the case is that on 25.01.2025 the informant/mother of the victim alleging that two days prior of this occurrence juvenile petitioner threatened to kidnap the victim. On 25.01.2025 at about 4:00 am, the daughter of the informant aged about 16 years had gone to attend natural call but did not return back. Further she alleged that after search, when she could not get the trace of her daughter, she along with other acquaintance went to the house of this petitioner and found that this petitioner is also not present at his house. The family members of this petitioner did not answer their questions and did not state anything about the petitioner and her daughter. The mother of the victim/informant further alleged that prior to this occurrence also this petitioner has teased and threatened her daughter

and also stated to this informant to not to marry the victim anywhere else. She also stated that due to these reasons the victim has stopped her studies, hence the present case has been instituted. 4. The juvenile is aged about 16 years, who is in remand home since 12.02.2025 has approached this Court for his release on bail through is father, who is ready and willing to keep this juvenile under her proper care and custody. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has committed no offence as alleged in the F.I.R. It is further submitted that there is a case and counter-case filed between the parties. He lastly submits that the petitioner has been falsely implicated in the present case due to ulterior motive and village politics. 5. Learned Spl. PP has vehemently opposed the prayer for bail of the juvenile. 6. Having regard to the facts of the case, I am inclined to grant privilege bail to the petitioner.
Accordingly, the petitioner is directed to be release on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of this like amount each to the Satisfaction of learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Latehar P.S. Case No.21 of 2025, special POCSO Case No.16/2025 corresponding to Juvenile Case No.05/2025 subject to the condition that one of the bailors must be the father of the petitioner. 7. Further, the concerned Probation Officer is directed to report, once in a month to the Juvenile Justice Board, Latehar regarding up keeping of minor. The Board is at liberty to take the juvenile in custody, if anything adverse is reported against the juvenile. 8. Accordingly, the instant criminal revision is allowed and the
order dated 15.04.2025 passed by learned Additional Sessions Judge-I- cum-Special Judge, Children Court, Latehar in Criminal Appeal No.17/2025, is hereby set aside.
