JUSTICE MRIDUL KUMAR KALITA ORDER Date : 13.10.2025 1. Heard Mr. G. Bordoloi, the learned counsel for the applicant. 2. This Interlocutory Application has been filed by the petitioner namely, Md Manir Uddin in connection with the Bail Application No. 1490/2025, wherein by order dated 06.08.2025, the petitioner was directed to appear before the Investigating Officer of Bongaigaon Police Station Case No. 40/2025 within seven days from the date of the said order. 3. The learned counsel for the petitioner has submitted that the petitioner could not appear before the Investigating Officer within the stipulated time as the certified copy of the order was furnish to him only on 12.08.2025 and, therefore, due to some ailment, he could not appear before the Investigating Officer. 4. He further submits that the petitioner ultimately appeared before the Investigating Officer on 05.09.2025, however, as there was no order regarding extension of the time, the Investigating Officer did not record the statement of the petitioner. 5. The learned counsel has submitted that the petitioner is ready and willing to cooperate in the investigation and he may be granted a fixed time to Page No.# 3/3 appear before the Investigating Officer. 6. Considering the submissions made by the learned counsel for the petitioner in light of the material available on record, the prayer is allowed. 7. The petitioner is allowed to appear before the Investigating Officer within the next ten days from the date of this order and cooperate in investigation. 8.
