Neutral Citation No. - 2025:AHC-LKO:39227 Court No. - 18 Case :- WRIT - A No. - 7373 of 2025 Petitioner :- Lucky Pandey (Pno - 112322377) Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 3 Others Counsel for Petitioner :- Vyomesh Chandra Shukla Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.
2. Petition has been filed challenging order dated 24th June, 2025 whereby petitioner working on the post of Constable in U.P. Police has been transferred from district Gorakhpur to district Deoria. Also under challenge is the order dated 6th June, 2025 which was passed rejecting petitioner's earlier representation seeking transfer to district Azamgarh in the light of directions passed by this Court in Writ A No. 4623 of 2025.
3. At the very out set, learned counsel for petitioner on the basis of instructions does not seek to challenge to the order dated 6th June 2025 since a fresh transfer order has been passed subsequently which is also under challenge.
4. It has been submitted that petitioner is the mother of two minor children and will face considerable hardship in case she is transferred in pursuance of impugned order. It is submitted that petitioner has also sought transfer to district Azamgarh in view of the fact that her husband is employed there in a private company. It is therefore submitted that petitioner's case may be considered sympathetically.
5. It is noticed that earlier petitioner's representation was rejected prior to passing of the impugned order and therefore may not have a bearing with regard to present transfer dated 24th June, 2025. Since petitioner's grievances would require
consideration of factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party No.3 i.e. Additional Director General of Police (Establishment), U.P., Lucknow. In case such a representation is filed, the same is required to be decided sympathetically ignoring earlier rejecting
order dated 6th June, 2025 within a period of three weeks from the date a certified copy of this order is produced before the said authority.
6. With aforesaid observations and directions, the petition is finally disposed of.
