G VENKATA REDDY Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the followin Order:- This Criminal Petition, under Section 482 of the Bharaf,-ya IVagar7-A Suraksfta Sat,h,-fa, 2023, has been filed by the petitioner herein/A6, seeking anticipatory bail, in connection with Crime No.51 of 2025 of Chodavaram Police Station, Anakapalli District. 2. -A case has been registered against the petitioner herein and others for the offences punishable under Sections 109(1), 118(1), 115(2), 351(2),126(2) read with 3(5),137(2) read with 62 of the Bharatiya Nyaya Sanhita, 2023. 3, Case of the prosecution, in brief, is that for the past 20 years, civil disputes were pending b.etween the families of the c/e facfo complainant and Al in respect of the land purchased by both the €`-.`--? Jf families jointly. On 01.03.2025, while the c/e facfo complainant's husband was taking treatment in the Government Hospital, Chodavaram for the injuries sustained by him, the accused are alleged to have gone to the hospital at about o1.00 pm and tried to kidnap him, but in vain. However, the accused are alleged to have beat the husband of the de facfo complainant indiscriminately, resulting in he falling unconscious. 4. Heard. Perused the record. 5. Learned counsel forthe petitionersubmits thatthis court granted anticipatory bail to A4 vide order dated 29.04.2025 in Crl.P.No.4034 of 2025. The case of the present petitioner is also on the same footing as that of A4. 6. Heard both sides. Perused the record. 7. A perusal of the order dated 29.04.2025 in Crl.P.No.4034 of 2025 goes to show that this Court granted anticipatory bail to A4 on the gro'und that long standing disputes between the families of both Al and the defacto complainant and civil cases were filed against each other in respect of a land. Except stating that all the accused are alleged to have beaten the husband of the defacto complainant, no specific overt act has been attributed against them. 8. In view of the aforesaid facts and circumstances of the case, since A4 who is on the same footing as of petitioner herein/A6 was granted anticipatory bail, this Court is inclined to grant anticipatory bail to petitioner herein/A6 on the following conditions. i) ln the event of arrest of the petitioner/A6 in the above crime, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. 9. Accordingly, the Criminal Petition is allowed.
