THE HON’BLE SRI JUSTICE BATTU DEVANAND CONTEMPT CASE No.576 of 2020 ORDER: This Contempt Case is filed complaining wilful disobedience of the order dated 20.03.2020 in W.P.No.7511 of 2020. 2. While disposing the said Writ Petition in W.P.No.7511 of 2020, this Court directed the respondents therein not take recourse to extra judicial means or any other procedure unknown to law, if the petitioner substantiates his right and interest to an extent of Ac.0.20 cents of land in R.S.No.502/2, which is classified as Gramakantam of Yeditha Village, Mandapeta Mandal, East Godavari District. This Court also made it clear that in the event of the petitioner failing to substantiate his claim to his land, the respondent authorities can well proceed with reference to this land by following due process of law. 3. In the reply affidavit, the respondent No.2 stated that after obtaining consent of the Gram Panchayat, when the land was being levelled by removing the bush growth and scattered trees, the petitioner claimed that he is in possession of Ac.0.20 cents in Sy.No.502/2. In obedience of the orders of this Court, dated 20.03.2020, the extent of land claimed by the petitioner i.e., Ac.0.20 2 cents was not touched. While levelling and stone planting works were taken up in the remaining extent of land only. 4. Considering the statement made by the respondent No.2 in his reply affidavit that the petitioner land was not touched, in our considered view, there is no contempt committed by the respondents in this case. 5. Accordingly, the Contempt Case is closed. No order as to costs.
