This is an application under Section 419(4) of BNSS, 2023, for grant of Leave to Appeal. 2. Learned counsel for the petitioner would submit that the complaint case filed by the petitioner under Section 138 of the Negotiable Instrument Act, 1881, has been dismissed for want of prosecution on 10.02.2025. 3. On that day, the case was fixed for appearance of the respondent accused but due to inadvertence neither the complaint nor his counsel could appear 2 and the case was dismissed for want of prosecution, therefore, the same may be restored. 4. On due consideration the application for grant of leave to appeal under Section 419(4) of BNSS, 2023, is allowed and leave granted. 5. The Registry is directed to register the present case as regular acquittal appeal and thereafter, list the regular acquittal appeal for consideration in the next week. 6.
