1. Heard.
2. Petitioner's counsel says that a similar petition bearing Writ- C No.6380 of 2025 [Manoj Kumar & Anrs. vs. Collector, Barabanki] has been decided on 04.07.2025 and this petition be also disposed of accordingly in the same terms.
3. Learned counsel for the opposite parties as also learned counsel for opposite party no.4, do not have any objections.
4. The said order dated 04.07.2025 passed in the aforesaid petition reads as under:-
"Heard Shri Dinesh Kumar Mishra, learned counsel for the petitioners and Shri Manish Mishra, learned Additional Chief Standing Counsel for the State. Shri Manish Mishra, learned Additional Chief Standing Counsel for the State makes a statement that in pursuance to the impugned notice dated 19.02.2025 the noticees have submitted their objections which are being considered and now, the next date fixed is 14.07.2025. The petitioners before us are the occupants of the premises which are proposed to be demolished. They claim to have entered into a builder's agreement with the owner and are aggrieved by the fact that the notices have not been issued to the occupants rather to the owners. Let the petitioners approach the Prescribed Authority which has issued the impugned notice and submit their objections, if they have locus and a cause. If they have locus, then, their objections would also be considered as per law. In fact, at this stage, the learned Additional Chief Standing Counsel says that the Prescribed Authority has given instructions that their objections would be considered.
As the proceedings are fixed for 14.07.2025 there is no question of demolition prior to that. With the aforesaid observations/directions, the writ petition is disposed of."
5. Accordingly, this petition is also disposed of in the same terms. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 9.7.2025 Shanu/- Digitally signed by :- SHANU SUMAN High Court of Judicature at Allahabad, Lucknow Bench
