Neutral Citation No. - 2025:AHC-LKO:39094-DB Court No. - 2 Case :- WRIT - C No. - 6503 of 2025 Petitioner :- M/S Ranajana Pandey Thru. Proprietor Ranajna Pandey And Another Respondent :- State Of U.P. Thru. Prin. Secy. Rural Engineering Deptt. Lko. U.P. And 8 Others Counsel for Petitioner :- Vivek Kumar Rai,Ajai Kumar,Ayush Tandon,Sachin Yadav Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard learned counsel for the petitioners and Shri Siddharth Dhaon, learned Additional Chief Standing Counsel for the State. Shri Siddharth Dhaon, learned Additional Chief Standing Counsel for the State says that the tender in pursuance to which bid had been submitted by the petitioner and in which she has been declared non -responsive has been cancelled and ultimately, it was found that the stage of financial bid only one bidder remained. A fresh tender has been floated in which the petitioner can participate. The petitioners' counsel submitted that because she has been declared non-responsive in the tender which has subsequently been cancelled, therefore, she would not be eligible for participating in the second tender or re-tender. However, Shri Dhaon, learned Additional Chief Standing Counsel for the State says that this apprehension is misconceived. There is no impediment in participation of the petitioners in the re-tender. As nothing survives for adjudication in the matter, especially, in view of the statement made by Shri Dhaon, learned Additional Chief Standing Counsel for the State the writ petition is disposed of. .
