HIGH COURT OF JUDICATURE AT ALLAHABAD APPLICATION U/S 528 BNSS No. - 41232 of 2025 Court No. - 79 HON'BLE AVNISH SAXENA, J. 1. Sri Rateesh Singh, learned counsel for the applicant/informant has moved the present applicant with the following prayer seeking to interpret the order dated 22.05.2024 (sic.letter dated 23.05.2024) of Judicial Magistrate concerned. The relief is reiterated underneath:- "It is, therefore, Most respectfully prayed that this Hon'ble Court may kindly be pleased to interpretate the order dated 22.05.2024 passed by the learned trial court removing the legal impediment before the trial court for deciding Case No. 165 of 2021 (State Vs. Ramprakash Sharma and others), arising out of Case Crime No. 411 of 2017, under Sections 420, 467, 468, 471 and 120B IPC,Police Station Iglas, District Aligarh. It is further prayed that this Hon'ble Court may graciously be pleased to direct the trial court to comply with the order dated 29.04.2024 passed in Anticipatory Bail application No. 10633 of 2023 ( Ramkumar Sharma Vs. State of U.P. and others), otherwise applicant shall have irreparable loss and injury which cannot be compensated in any manner." 2. This Court is of the opinion that the application moved under Section 528 BNSS is misconceived as through this application the High Court is required to interpret the letter dated 23.05.2024 of the Judicial Magistrate. Anticipatory Bail Application under Section 438 Cr.P.C Mo-10633of 2023 dated 29.04.2023 4 application under section 482 No- 12721/2021 dated 10.08.2021 में पािरत आदेशों के संबंध में। महोदय, महोदय को ससम्मान अवगत कराना है िक माननीय उच्च न्यायालय इलाहाबाद के द्वारा Cri. Misc. Anticipatory Bail Application under Section 438 Cr.P.C No-10633 of 2023 में िदनांक 29.04.2023 को अिभयुक्त रामकु मार के अिग्रम जमानत प्राथर्ना पत्र पर सुनवाई करते हुये नु०अ०नं० -411/2017 अंतगर्त धारा 420, 467, 468, 471 व 120B IPC में इस न्यायालय का छः माह के भीतर िवचारण पूणर् करने के िनदेर्श िदये गये है। इसी मामले में अिभयुक्त शिश शमार् की यािचका Application under section 482 No-12721/2021 में माननीय उच्च न्यायालय के द्वारा िदनांक 10.08.2021 को प्रस्तुत प्रकरण में त्तभी धायर्वाही जो स्थगित कर िदया गया था। अिभयुक्त शिश शमार् के द्वारा प्राथर्ना पत्र के माध्यम से माननीय उच न्यायालय में लंिबत यािचका से संबंिधत प्रपत्र दािखल िकये है एवं माननीय उच्चतम न्यायालय के द्वारा High Court Bar Association, Allahahabd vs. State of UP and Others 2024 (3) Scale 157 में पािरत िविध व्यवस्था प्रस्तुत की है िजसके आधार पर बाद की कायर्वाही को स्थिगत िकये जाने की याचना की गयी प्रस्तुत प्रकरण में दोनो अिभयुक्त के द्वारा जो आदेश दािखल िकये गये है ये आपस में िवरोधाभाषी है। अतः माननीय महोदय से सादर अनुरोध है िक प्रस्तुत मामले में मागर्दशर्न करने की कृ पा करें। NA528 No. 41232 of 2025 2 सादर। िदनाक-23.05.2024 भवदीय िसिवल जन (क०प्र०) न्याियक मिजस्ट्रेट इगलास, अलीगढ" 3.
