[2025:RJ-JP:24424] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 4990/2025 Rama Devi D/o Narpat Singh, Aged About 23 Years, R/o Chha Pokhar, Thana Achhnera District Agra Uttar Pradesh. (Presently Lodged In Central Jail, Bharatpur Since 19-02-2024). ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Satya Narayan Gupta For Respondent(s) : Mr. Shree Ram Dhakar, P.P.
HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 03/07/2025
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0026/2024 registered at Police Station Sadar Deeg, District Deeg for the offences under Sections 302 and 34 of I.P.C., 1860.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Learned counsel further submits that there is nothing incriminating against the petitioner. She has been involved in this case on the basis of hearsay evidence. Learned counsel also submits that even in the statement of PW-1-Santosh, recorded before the learned Trial Court, no incriminating statement has been made by him against
[2025:RJ-JP:24424] (2 of 2) [CRLMB-4990/2025] the petitioner. The co-accused i.e. Deewan Singh, the father of the deceased-Yash, was also enlarged on bail by the Co-ordinate Bench of this Court on 02.12.2024 and the case of the present petitioner is akin to that of co-accused Deewan Singh. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed.
4. On the contrary, learned Public Prosecutor has vehemently opposed the bail application and has submitted that as per the prosecution story, it was the petitioner who has thrown the deceased-Yash in the water tank and thereby caused the murder of deceased-Yash. The Co-ordinate Bench of this Court has allowed the bail application of Deewan Singh on the ground that prime accused is Rama Devi, therefore, she is not entitled to be released on bail.
5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case; and in backdrop of gravity of the offence and without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner.
6. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed.
