For Petitioner : Mr.K.Prabhakar For Respondent : Mr.D.Sasikumar Additional Government Pleader 1/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.18987 of 2025 ORDER This writ petition is filed for Writ of Cetiorarified Mandamus, to quash the record comprised in P/Karambakudi/20/2025 dated 27.06.2025 on the file of the respondent and consequently to register and release the sale deed in Doc.No.TP/224362378/2025, dated 27.06.2025 forthwith. 2.Through the impugned order, the respondent has stated that the document is kept pending for further analysis. The learned Additional Government Pleader on written instructions, submitted that the petitioner has registered a document by classifying the land as agricultural land and he has quoted the stamp duty applicable for the agricultural land. However, the respondent communicated that it has to be registered as a housing plot and not agricultural land. Therefore, there is a dispute in fixing the stamp duty. 4.After hearing the rivals submission made, this Court is of the considered 2/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.18987 of 2025 opinion that if the respondent is disputing the valuation of the land and fixing the stamp duty, the same cannot be the reason for declining the registration. 5.Accordingly, this writ petition stands allowed. The records comprised in P/Karambakudi/20/2025 dated 27.06.2025 on the file of the respondent is hereby quashed. The respondent is directed to release the sale deed in Doc.No.TP/224362378/2025, dated 27.06.2025 after referring the matter to the Stamp Collector under Section 47A of the Indian Stamp Act. The said exercise shall be completed within a period of two weeks from the date of receipt of a ocpy of this order. No costs.
