Heard the learned counsel for the parties.
2. The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Rajganj P.S. Case No. 08 of 2025 instituted under Sections 303 (2), 317 (2), 317 (5), 3 (5) of B.N.S., 3 (2) of the Coal Mines Act, 4 / 21 of Mine and Mineral (Regulation & Development) Act, 4/ 54 of JMMC Rule along with Section 7 /9 /13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation & Storage) Rules, 2017.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in this case. The allegation against the petitioner is totally false and fabricated and he has not committed any offence. In fact, petitioner is not having any knowledge regarding transportation of illegal coal, whatsoever rather the driver is the one who is driving the vehicle on the alleged date of occurrence without having knowledge to the petitioner. He further submits that the name of the petitioner is transpired in this case only on the basis of being owner of the said vehicle.
4. Learned A.P.P. opposed the prayer of the petitioner for grant of bail.
5. Having regard to the facts and circumstances of this case, I am inclined to extend privilege of anticipatory bail to this petitioner.

Accordingly, the petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Rajganj P.S. Case No. 08 of 2025.
6. It is made clear that petitioner shall co-operate with the investigation / trial. If the petitioner will not co-operate with the investigation / trial, the State would be at liberty to take appropriate action.
