Neutral Citation No. - 2025:AHC-LKO:39888 Court No. - 12 Case :- APPLICATION U/S 482 No. - 5506 of 2025 Applicant :- Akshay Mittal Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Applicant :- Aakash Yadav Counsel for Opposite Party :- G.A. Hon'ble Rajnish Kumar,J. Heard Shri Aakash Yadav, learned counsel for the applicant and learned A.G.A. This application has been filed challenging the order dated 23.05.2025 passed in Complaint Case No.16379 of 2025; M/s. D.P.Papers Pvt.Ltd. Versus M/s. Jauhari Printers Pvt. Ltd. and others, under Section 138 N.I.Act, Police Station-Aminabad, District-Lucknow by the Presiding Officer, Additional Court, N.I.Act-9, Lucknow. The sole argument advanced by learned counsel for the applicant is that there is all likelihood of settlement in the matter as there are business transactions between the applicant and the respondent no.2 as two cheques were issued and first cheque being dishonoured on account of insufficiency of funds, the second cheque of Rs.1,24,000/- was issued and the same was also dishonourned on account of insufficiency of funds, but the applicant has already paid the amount of one cheque amounting to Rs.1,24,000/- through R.T.G.S. and the same has been admitted in the complaint also and he is ready to pay the amount of second cheque also but in some time. In view of above, the applicant may settle the dispute with the respondent no.2 and make the payment and move to the concerned court, who may consider the same in accordance with law and pass appropriate orders. With the aforesaid the application is disposed of. . .................. ......................................(Rajnish Kumar,J.)
