Neutral Citation No. - 2025:AHC-LKO:39605-DB Court No. - 2 Case :- WRIT - C No. - 6500 of 2025 Petitioner :- Bhola Nath @ Bhola Soni And 4 Others Respondent :- General Manger Co-Operative Housing Construction And Finance Corporation Ltd. Lko. And 3 Others Counsel for Petitioner :- Surya Narayan Mishra Counsel for Respondent :- Rakesh Kumar Chaudhary Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. Petitioners claim to have paid the entire amount i.e. the loan which was taken by the mother of the petitioners. They had earlier approached the District Consumer Forum, which ruled in their favour to the extent that the concerned opposite party herein was required to inform the petitioners about the installments paid by them and adjust the amount already paid etc. The said judgment was upheld in appeal by the State Consumer Dispute Redressal Commission U.P., Lucknow. The
judgment of the State Forum is dated 17.08.2010. The petitioners say that there is a finding by the District Forum that an amount of Rs.32,466.11/- had been paid prior to 25.01.1996, when the District Forum rendered its judgment and after the
judgment of the State Forum, another amount of Rs.40,000/- was paid. They rely upon photocopy of a payment receipt, which appears to be of the year 2010. On being asked, the petitioners' counsel could not inform us as to what was the amount due which was sought to be recovered by issuance of citation of recovery by the revenue authorities in 2010. Unless the said fact is before us, it is not possible to adjudicate the dispute. In any case, the petitioners had earlier approached the District Forum, if they want, they can approach the Forum or they may approach the opposite parties themselves. Disputed questions of fact are involved, which cannot be seen under Article 226 of the Constitution of India. Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.)
