Vide order dated 26.06.2023, she was transferred from G.I.C. Ranibag, District Nainital to G.I.C. Khetikhan, District Champawat. 3. Petitioner has challenged transfer order mainly on the ground that she has undergone renal transplant in November, 2017, therefore she comes within the definition of the term ‘serious patient’, as per Transfer Act, 2017. 4. Coordinate Bench of this Court had passed interim order in favour of petitioner on 18.03.2024, which is still continuing. 5. Transfer is an incidence of service, and petitioner has served at her present place of posting for more than 1½ year on the strength of interim order passed in this writ petition. 6. No useful purpose would be served by keeping this petition pending. Accordingly, writ petition is disposed of by directing the Regional Additional Director of Education, District Nainital to revisit the transfer of petitioner and 2025:UHC:10640 pass necessary order afresh, within eight weeks. 7. For a period of eight weeks or decision is taken, whichever is later, status quo as regard petitioner’s posting shall be maintained.
