Neutral Citation No. - 2025:AHC:20718 Court No. - 5 Case :- WRIT - A No. - 4502 of 2021 Petitioner :- Manish Kumar Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Jitendra Kumar Srivastava Counsel for Respondent :- A.S.G.I.,R.P.S. Chauhan,Santosh Kumar Mishra Hon'ble Ajay Bhanot,J. Heard Shri Jitendra Kumar Srivastava, learned counsel for the petitioner, Shri Santosh Kumar Mishra, learned counsel for the respondent nos. 2 to 4. The petitioner claims that his case on compassionate ground appointment has not been considered. A representation in this regard has been made to the competent authority but to no avail. The only prayer made on behalf of the petitioner is that his representation may be decided within a stipulated period of time. Santosh Kumar Mishra, learned counsel for the respondent nos. 2 to 4 submits that the matter requires factual determination including the financial status of the family and other considerations as per applicable laws and Government Orders by the competent authority in the first instance. However, he fairly contends that the purpose of appointment on compassionate ground will be defeated in case the appointments are not processed in a reasonable period of time. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner for grant of appointment on compassionate ground as per law within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 13.2.2025 Dhananjai Digitally signed by :- DHANANJAI High Court of Judicature at Allahabad
