This appeal has been filed by the State/Appellant against the judgment dated 05.09.2011 passed by the Special Judge, Rajnandgaon, (C.G.) in Special Case No. 46/2010 wherein the accused/ Dr. R.U. Khan @ Rafiqullah Khan (respondent herein) has been acquitted from the offence punishable under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. Learned State Counsel submits that the complainant Dr. Sunil Kumar Bhandekar had also preferred an appeal i.e. ACQA No.135/2011 PRAKASH KUMAR Digitally signed by PRAKASH KUMAR Date: 2025.08.08 17:43:45 +0530 2 against the impugned judgment dated 05.09.2011, wherein the State of Chhattisgarh was also made party being arrayed as respondent No.1, and the said acquittal appeal has already been dismissed on merits on 14.12.2021 by the Co-ordinate Bench of this Court. 3. In view of the above, the present acquittal appeal filed by the State of Chhattisgarh against the same impugned judgment dated 05.09.2011, is not maintainable. 4.
