Respondent/s ====================================================== Appearance : For the Appellant/s : Mr.Rakesh Ranjan For the Respondent/s : Mr.Binay Krishna ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 23-04-2025 Heard the learned counsel for the appellant as well as the learned APP for the State. 2. This appeal has been preferred against the order dated 30.11.2022 passed by learned 1st Additional District and Sessions Judge-cum-Special Judge SC and ST Act, Muzaffarpur in connection with SC/ST Complaint No. 161 of 2022 for the offences punishable under Sections 354, 323, 379, 384 of the Indian Penal Code and Section 3(1)(x)(v) of the Scheduled Caste and Schedule Tribe. 3. The dispute in this case is of civil nature as the Patna High Court CR. APP (SJ) No.441 of 2023(3) dt.23-04-2025 2/2 complainant is purchaser of the land from the opposite party No. 2. The learned court below has found that the occurrence did not take place due to malicious feelings of castes. The impugned order itself shows that this is a dispute of civil nature and the criminal liability does not arise. The learned court below has rightly refrained from issuing the process against the opposite party number 2. 4. I see no reason to interfere with the impugned order. Accordingly, this appeal is dismissed. kundan/- (Nawneet Kumar Pandey, J) U T
