Petitioners are apprehending their arrest in connection with Baharagora P.S. Case No. 04 of 2025, for the offence registered under Sections 420, 406, 409,120 B of the Indian Penal Code. 3. The learned Counsel for the petitioners submits that the petitioners have not committed any offence as alleged in the F.I.R. They have been falsely implicated in the present case based on unfounded and concocted allegations made by the informant who is the Branch Manager of Bharat Financial Inclusion Limited. The petitioners have not committed any criminal breach of trust and there is no independent or credible material on record to suggest that the petitioners have misappropriated any amount. The allegations are based solely on internal company records, which have not been properly verified. 2 No recovery has been made from the petitioners nor there is any cogent evidence on record linking them to the alleged conspiracy or embezzlement and the petitioners have no criminal antecedent. Hence, they may be given the privilege of anticipatory bail. 4. Learned A.P.P. opposed the prayer for anticipatory bail. 5. Having regard to the facts of the case and looking to the allegation made against the petitioners, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are directed to surrender before the court- below within a period of four weeks from today and the learned court below on their surrender shall release them on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Ghatshila in connection with Baharagora P.S. Case No. 04 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 6. It is made clear that the petitioners shall cooperate in the investigation/trial and if the petitioners will not cooperate in the investigation/trial, the State would be at liberty to take appropriate action.
