2. The petitioner, who was arrested on 18.05.2025, is seeking regular bail under section 483 BNSS, 2023 in connection with Basistha P.S. Case No. 259/2025 under sections 123/ 305(a) of the BNS, 2023 has prayed for bail. 3. The learned APP by referring to the forwarding of the arrested accused person has objected to the prayer of bail on the ground that the petitioner is involved in robbing innocent victim and robbing them of valuables. It is also submitted that the petitioner is involved in various such incidents including a case at Diphu Police Station which is registered as Diphu P.S. Case No. 104/2024 under Sections 123 /303(2) of the BNS, 2023 where is an absconder. 4. Considering that the petitioner was arrested on 18.05.2025 and spent more than a month in custody, further custodial interrogation of the petitioner will not be necessary. Accordingly, the Court is inclined to provide that in the event the petitioner, namely, Haran Ali is ready and willing to submit a bail bond of Rs. 20,000/- (Rupees Twenty thousand only) with 2 (two) sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate (CJM), Kamrup (Metro), Guwahati, petitioner shall, subject to requirement in Diphu P.S. Case No.104/2024 be released on bail. The bail is granted on the following conditions:
1. The petitioner shall make himself available to the police or any other investigating agency or the Court as and when required. 2. The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
He shall not, in any manner, try to overawe or influence or intimidate the prosecution witness. Page No.# 3/3
3. The petitioner shall not obstruct the smooth progress of the investigation/trial. 4. The petitioner shall not misuse their liberty in any manner. 5. The petitioner shall appear before the I/O every 15 days from the date of his release till his personal appearance is no longer required or till charge- sheet is filed, whichever is earlier. 6. In the event petitioner fails to comply with the conditions of bail or is found to have been involved in any other such offence, liberty is granted to the I.O. to move the jurisdictional court for cancellation of bail. 5.
