No one is present for the applicant even in the revised call, however, Shri Mukesh Kumar, learned counsel for the opposite party is present. 2. The present application under Section 24 of C.P.C. has been preferred by the applicant for transfer of matrimonial proceedings of Case No. 274 of 2025 (Mahesh Kumar vs. Smt. Nisha @ Tanu Rawat), pending in the Court of Additional Principal Judge, Family Court, Sultanpur to the equivalent court at District Allahabad/Prayagraj. 3. The contention in the application is that the applicant-wife, is blessed with a daughter, who staying with the applicant and on account of inconvenience faced, the transfer proceedings have been filed. 4. Counsel for the respondent opposes the same by arguing that earlier a petition under Section 9 of the Hindu Marriage Act was filed, which was decreed, in which the applicant had stated that she does not want to live with the respondent. 5. It is further argued that the respondent has elder parents to take care of and, thus, it is also inconvenient for him travel to Allahabad. It is also argued that the father and brother of the applicant had threatened, the respondent at Balrampur for which an F.I.R. was also lodged under Section 504 and 506 I.P.C. in which charge sheet has also been filed. 6. Considering the inconvenience coupled with the fact that applicant has a daughter to maintain, who is a very small, solely on this ground, the present application is allowed. The proceedings pending in the Court of Additional Versus Counsel for Applicant(s) : Chandra Bhushan Counsel for Opposite Party(s) : Smt.
