And Another Counsel for Applicant :- Krishna Kumar Vishwakarma,Punit Kumar Yadav Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No.169 of 2025, under Sections 109, 110, 115(2), 352 BNS, Police Station Jaisinghpur, District Sultanpur. In the prosecution case it is alleged that at about 11:30 pm, the accused persons came on two motor-cycles and assaulted his father Shyam Lal Gupta who was lying in front of his shop. They have beaten him by lathi, danda and have inflicted injuries.
Learned counsel for the applicant submits that general role has been assigned to all the accused persons except one injury on the right knee, the other five injuries are simple in nature. It is not a case under Section 109 BNS. The applicant has been falsely implicated. The applicant has explained the criminal history in paragraph 23 of the bail application. Learned A.G.A. has opposed the bail application however, he has not disputed that injury on the right knee is a grievous injury and other injuries are simple in nature and also that the general role has been assigned to the applicant along with other co-accused persons. Perused the record along with the case diary, statement of the injured, injury report, it is borne out from the record that one out of six injuries received by the injured is a grievous injury,
the victim-injured remained admitted in district hospital from 17.05.2025 to 26.05.2025, the injured has supported the prosecution case in his statement, therefore, I am of the view that the this is not a case of false implication nor the F.I.R. has been lodged to injure the reputation of the applicant accordingly, the anticipatory bail application is liable to be dismissed and is hereby dismissed.
