Annexure No.1 shows that the death occurred on account of being struck by lightening and it says that once the viscera report is received, the claim for compensation under the 'Daiviya Apada Scheme' would be considered, whereas the petition speaks of the benefit under the 'Mukhyamantri Krishak Durghatna Kalyan Yojna' under which, there is no application as informed by learned Standing Counsel. We find merit in the submission of learned Standing Counsel. The Writ Petition is dismissed, however, with liberty to the petitioner to move a fresh application before the competent authority seeking compensation/financial assistance under the State Disaster Response Fund or the National Disaster Response Fund, as the case may be.
