NHAI Vs Karam Singh and others OMP(M) No. 261 of 2025 02.04.2026 Present: Ms. Shreya Chauhan, Advocate, for the applicant. None for the respondents. The applicant has preferred the accompanying appeal under Section 37 of the Arbitration and Conciliation Act. Since the appeal has been filed after the prescribed period of limitation, hence, the present application has been filed for condoning the delay. The delay, as per the application is 175 days and as per the report of Registry, the delay is of 318 days.
2. The delay has mainly been sought to be condoned on the ground that before filing the appeal, matter has been dealt with at various stages. The application has been duly supported by the affidavit of Varun Chari, Project Director.
3. When put to notice, the respondents have neither put appearance before this Court, nor they have contested the allegations, as levelled in the application, upon which, the delay has been sought to be condoned.
4. Considering the stand taken by the applicant, this Court is of the view that the applicant is able to make out a case for condonation of delay. Consequently, the application is allowed and delay in
filing the accompanying appeal is ordered to be condoned.

9. Application is considered and allowed. During the pendency of the appeal, which has been admitted, the execution of the award dated 15.02.2023, passed by the Divisional Commissioner Mandi, exercising the power of Arbitrator, is ordered to be stayed, subject to the condition that the applicant shall deposit the entire awarded amount, along with uptodate interest, within a period of eight weeks, from today.
