This first bail application has been moved by the applicant seeking regular bail in F.I.R./Case Crime No.16 of 2025, under Section 137(2), 64(2)(m) of B.N.S., 2023 and Section 5(l)/6 of POCSO Act, registered at Police Station SIDCUL, District Haridwar. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime, has no criminal history and is languishing in jail since 20.01.2025. He submits that, at the time of alleged incident, the victim was 18 years, 7 months and 29 days old. He submits that in the statement recorded under Section 180 of BNSS, the prosecutrix has categorically stated that she was in love with the applicant and had accompanied him on her own sweet will. Learned counsel for the applicant further submits that the victim has turned hostile. He submits that the applicant, aged about 27 years, is a young man, and his continued incarceration would have an adverse impact on his future and career prospects. 4. Learned State Counsel vehemently opposed the bail application. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that 2025:UHC:10573 applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Sanju be released on bail, on executing personal bond by each one of them and furnishing two reliable sureties by each one of them, each of like amount, to the satisfaction of Court concerned.
