Page No.# 2/3 has prayed for bail, who was shown arrested on 22.05.2025 in connection with Diphu P.S. Case No. 104/2024, under section 123/303(2) of the BNS, 2023. 3. The prayer for bail is opposed by the learned APP on the ground that as per the forwarding report of the petitioner in connection with Basistha P.S. Case No. 259/2025, under section 123/305(a) of the BNS, 2023, the modus operandi of the petitioner is to drug the victim and to rob them of their valuables and apart from Diphu P.S. Case No. 104/2024, the petitioner is also an accused in the Basistha P.S. Case No. 259/2025. 4. As per the contents of the Annexure-VI to this bail application, which is a photocopy of certified copy of order dated 23.05.2025, the prayer of the Investigating Officer for police remand of the petitioner was rejected and the Investigating Officer was allowed to interrogate the petitioner in the jail premises. 5. Under such circumstances, taking note that the petitioner was produced before the Court of learned Chief Judicial Magistrate, Karbi Anglong, Diphu on 23.05.2025, the Court is of the considered opinion that further custodial interrogation of the petitioner may not be necessary. Hence, the Court is inclined to grant bail to the petitioner, namely, Haran Ali in connection with Diphu P.S. Case No. 104/2024 on furnishing bail bond of Rs.50,000/- with 2 (two) solvent sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate, Karbi Anglong, Diphu. 6. The bail is granted on the following conditions: (a) That the petitioner shall make himself available to the police or any other investigating agency or the Court as and when required.
Page No.# 3/3 (b) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. He shall not, in any manner, try to overawe or influence or intimidate the prosecution witness. (c) That the petitioner shall not obstruct the smooth progress of the investigation/trial. (d) That the petitioner shall not misuse his liberty in any manner. (e) That the petitioner shall not jump over the bail. (f) The petitioner shall appear before the I.O. once in every month till charge-sheet is filed or his appearance is dispensed with by the I.O, whichever is earlier. 7. In the event the petitioner fails to appear before the I.O. or he is found involved in any other such offence, it would be open for the I.O. to move the jurisdictional Court and apply for cancellation of bail. 8.
