2. This writ petition has been filed by the petitioner under Article 227 of the Constitution of India seeking a direction to the Trial Court – Ist Additional District Judge, Dehradun, to expedite hearing of the SCC Suit No.14 of 2024, Sarita Gupta Vs. Shravan Kumar Gupta, within a stipulated period.
3. It is contended by counsel for the petitioner that S.C.C. suit was filed by the petitioner for recovery of rent and eviction of the suit on 02.02.2024 in the court of Judges Small Causes Courts/District Judge, Dehradun.
4. The respondent-defendant appeared in the suit and the written statement has been filed.
5. It is also contended by counsel for the petitioner that on 19.09.2024 the petitioner filed his affidavit of examination-in-chief along with documents on which the respondent-defendant sought time for filing objection and examination of the petitioner-plaintiff.
6. It is contended by counsel for the petitioner that since then the respondent-defendant is continuously seeking adjournment for one reason and another and the suit is being delayed.
7. It is for that reason counsel for the petitioner is before this Court for a direction to the Trial Court to decide the suit expeditiously.
8. From perusal of the order sheet, which is annexed
2 by counsel for the petitioner with the writ petition it seems that the contention of counsel for the petitioner is correct that the matter is being delayed by the respondent-defendant for one reason and another.
9. Since right of speedy justice is a fundamental right and in view of the facts and circumstances of the case, the writ petition deserves to be allowed with a direction to Trial Court – Ist Additional District Judge, Dehradun, to expedite hearing of the SCC Suit No.14 of 2024, Sarita Gupta Vs. Shravan Kumar Gupta, and to decide it within a period of ten months from the date of production of certified copy of this order.
