Neutral Citation No. - 2025:AHC-LKO:38567 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 761 of 2025 Applicant :- Ajaz Ahmad Opposite Party :- State Of U.P. Thru. Secy. Home Lko. Counsel for Applicant :- Dildar Khan,Rehan Ahmad Siddiqui Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present bail application under Section 438 Cr.PC. has been filed seeking anticipatory bail in case crime/FIR No. 16/2022, under Sections 406/467 I.P.C., P.S. Shivgarh, District Sultanpur. Heard learned counsel for the applicant and learned A.G.A. for the State. In the prosecution case, it is alleged that the applicant, who was working as a taxi driver in Mumbai, misrepresented himself as a Manager at the State Bank of India by using a forged SBI identity card and, on that basis, persuaded the complainant to marry his sister with him. Following the marriage, an amount of 2,80,000/- was transferred to the applicant’s account through ₹ 14 separate transactions by his in-laws. It is further alleged that an additional demand of Rs. 5,00,000/- and a Baleno car was also made by the applicant. Perused the record. A perusal of the case record reveals that the applicant is absconding. During the course of investigation, Sections 406 and 467 of the IPC have been added, and proceedings under Section 82 Cr.P.C. have also been initiated against him. Notably, the offence under Section 467 IPC is punishable with imprisonment for life. In view of the above facts, it does not appear to be a case of false implication or the FIR has been lodged merely to malign the applicant’s reputation. Accordingly, no ground for granting anticipatory bail is made out. The application for anticipatory bail stands rejected. Order Date :- 8.7.2025 R.C.
