Ajay Mohan Goel, Judge (Oral) By way of this petition filed under Section 24 of the Code of Civil Procedure, a prayer has been made for transfer of the matter, i.e. case No. HMA Case No. 11 of 2025, titled as Rahul Kumar vs. Kiran Bala, which has been filed by the respondent against the petitioner, which is pending adjudication in the Court of learned Additional District and Sessions Judge (Family Court), Sarkaghat, camp at Joginder Nagar, District Mandi, to the Court of learned Additional District and Sessions Judge (Family Court), at Palampur, District Kangra. 2. Learned Counsel for the petitioner has submitted that the petitioner after the acrimony of relationship between her and the respondent is presently residing at village Kalyankar, Post Office Vrindaban, Tehsil Palampur, District Kangra, with her parents and she has a 8 months old baby to look after. Learned Counsel for the respondent stated that though the ground raised in the petition are not correct but the respondent has no objection in case the matter, as prayed for, is transferred to the Family Court at Palampur. 3. In light of the submissions made by learned Counsel for the petitioner as well learned Counsel for the respondent, this petition is disposed of by ordering transfer of case No. HMA Case No. 11 of 2025, titled as Rahul Kumar vs. Kiran Bala, from the Court of Additional District and Sessions Judge (Family Court) Sarkaghat, camp at Joginder Nagar to the Court of learned Additional District and Sessions Judge (Family Court), Palampur, District Kangra, H.P. Learned Additional District and Sessions Judge (Family Court), Sarkaghat, District Mandi, is directed to ensure that the case file, complete in all respects, is forthwith transferred to the Court of Additional District and Sessions Judge (Family Court), Palampur, District Kangra and on the receipt of case file, learned Family Court, Palampur, is directed to issue notice to the parties for their appearance before said Court for a specific date.
