Home Deptt. Lko. And Others Counsel for Petitioner :- Amar Singh,Adarsh Srivastava Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Brij Raj Singh,J. 1.Heard learned counsel for the petitioners as well as learned A.G.A. who appears for the State-respondents and perused the record.
2. The instant writ petition has been filed with the following prayers:
"(i)Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties not to harass the petitioners and their minor sister Mahima Singh and not to disturb their peacefully and happy life in any manner, in the interest of justice. (ii)Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite party no.2 to take appropriate action on the application dated 9.6.2025 made by the petitioners contained in Annexure No.1 to this writ petition and issue necessary directions within a period as fixed by this Hon'ble Court, in the interest of justice."
3. We have gone through the representation made by the petitioners to the Police Commissioner. Learned A.G.A. has pointed out that F.I.R. lodged by Arun Singh, the alleged step father of the petitioners under Sections 420, 467, 468, 471 and 342 I.P.C.in F.I.R. No. 0897 of 2024. It has been submitted on the basis of the contents of the F.I.R. that in case the petitioners have any grievance regarding the conduct of step father Arun Singh, they may approach the Investigating Officer where the investigation is still going on. Their case shall be considered by the Investigating Officer by submitting the charge-sheet/final report, if any to the Magistrate concerned.
4. Accordingly, the petition is disposed of with the observation that the Investigating Officer is bound to follow the provisions of paragraph 107 of the Police Regulations in conducting the investigation. We find no good ground to ask the Police Commissioner to interfere in the investigation, which is already being carried out by the Investigating Officer. (Brij Raj Singh,J.) (Sangeeta Chandra,J.)
