Neutral Citation No. - 2025:AHC-LKO:38504 Court No. - 6 Case :- WRIT - C No. - 6368 of 2025 Petitioner :- Govind And 2 Others Respondent :- Commissioner Ayodhya Mandal, Ayodhya And 3 Others Counsel for Petitioner :- Brijesh Kumar Yadav,Surya Prakash Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Alok Mathur,J.
1. Heard Sri Brijesh Kumar Yadav, learned counsel for the petitioners as well as learned Standing Counsel for the State respondents.
2. By means of present writ petition the petitioners have challenged order dated 27.11.2024, passed in Suit No. 2822 of 2014, under Section 333 of the U.P. Z.A. & L.R. Act. The revision preferred by the private respondents has been allowed.
3. Learned Standing Counsel has raised preliminary objection that petitioners have efficacious alternate remedy of filing revision before the Board of Revenue, considering the fact that the order impugned in the present writ petition was passed on revision petition preferred by the private respondents. Consequently, petitioners have adequate alternate remedy of filing revision before the Board of Revenue.
4. Learned counsel for the petitioners does not oppose the preliminary objection raised by the respondents and fairly submits that he may be permitted to withdraw the present writ petition with liberty to the petitioners to file revision before Board of Revenue.
5. Accordingly, present writ petitioner is dismissed as withdrawn with liberty to the petitioners to file revision before the Board of Revenue. Order Date :- 8.7.2025 A. Verma (Alok Mathur, J.) Digitally signed by :- ANURAG VERMA High Court of Judicature at Allahabad, Lucknow Bench
