138 Supp IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) 3239/2025 CM(8700/2025) HYDER KARRAR BIN MUSHTAQ LONE ….. Petitioner (s) Through: Mr. Ruaani Ahmad Baba, Advocate. V/s UNION TERRITORY OF J AND K AND ANR. ….. Respondent(s) Through: Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 24.12.2025 The short grievance that has been projected by the petitioner in the present petition is, that his appeal under Section 17(1) (i) of Jammu and Kashmir Reservation Act, 2004 against order dated 02.08.2025 passed by the Tehsildar, Handwara whereby issuance of RBA Certificate in favour of the petitioner has been refused, is not being decided by the Appellate Authority (Deputy Commissioner, Kupwara) expeditiously. It has been contended that as per Section 17 of the Jammu and Kashmir Reservation Act, 2004, an appeal is to be decided within 30 days from the date of receipt of the appeal, but in the instant case, the petitioner has filed appeal on 19.08.2025 but till date, the same is not being disposed of by the Appellate Authority. Having regard to the limited nature of the grievance projected by the petitioner, the petition is disposed of with a direction to the Appellate Authority i.e, Deputy Commissioner, Kupwara to decide the appeal filed by the petitioner most expeditiously preferably within a period of 15 days from the date a copy of this order is made available to the said Authority.
