Neutral Citation No. - 2025:AHC-LKO:38248 Court No. - 18 Case :- WRIT - A No. - 7130 of 2025 Petitioner :- Bina Devi Respondent :- State Of U.P. Thru. Its Addl. Chief Secy. Child Development And Nutrition Lko. And 3 Others Counsel for Petitioner :- Arvind Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner, learned State Counsel for the opposite parties.
2. In view of order being passed, notice to respondent no. 4 stands dispensed with.
3. Petition has been filed challenging appointment of respondent no. 4 i.e., Smt. Sudha Devi wife of Gauri Prasad on the post of Anganbadi Karyakatri in Villlage Ailara, Block Gaindas Bujurg, District Balrampur. Further prayer for
consideration of petitioner's candidature on the said post has also been sought.
4. From a perusal of material available on record, it appears that petitioner had applied in pursuance of advertisement issued on
14.10.2024. In paragraph no. 10 of the writ petition, it has been stated that there was mistake in feeding caste certificate number in the online application, which was submitted on 02.11.2024 whereafter she moved a correction application on 05.11.2024, which however, has not been considered. It is also admitted in paragraph no. 13 of the writ petition that subsequently respondent no. 4 Smt. Sudha Devi has already been selected and appointed on the said post.
5. It is thus evident that petitioner admits that online application
form for purposes of recruitment was filled wrongly by the petitioner herself way back in November 2024 and therefore in the considered opinion of this Court such an admission will operate as estoppel against petitioner. Even otherwise, petitioner has filed this petition belatedly after almost eight months of the said inaction. 6, In such circumstances, this Court does not find any ground to interfere in the matter. Therefore, petition fails and is dismissed at the admission stage itself.
