Gaunjhu, A.P.P. ----- Order No.02 Date: 29th May, 2025 The petitioners are accused for the offences punishable under Sections 303(2) and 3(5) of the BNS, 2023. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. The Petitioner No.1 is helper and petitioner No.2 is the driver of the truck bearing Registration No.MH-40-CD-6528 on which 23 pieces of D1-150 mm pipes were found loaded. The petitioners have no criminal antecedents as has been stated in Paragraph No.13 of the present bail application. The petitioners are in judicial custody since 31.03.2025. Hence, they may be given the privilege of regular bail. 3. Learned A.P.P. has opposed the petitioners’ prayer for regular bail. 4. Having heard learned counsel for the parties, considering the materials available on record as well as keeping in view that the petitioners are in judicial custody since 31.03.2025, I am inclined to enlarge them on bail. 5. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.20,000/- 2025:JHHC:14302 Page | 2 (Rupees Twenty Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ghatshila in connection with Baharagora P.S. Case No.23 of 2025, subject to the condition that the petitioners shall co-operate in the trial and shall present as and when required by the learned Trial Court, failing which the said court is at liberty to cancel the bail bond of the petitioners.
