According to the petitioner, her husband Beerendra Prasad Pant was employed as Ward Boy in Government Ayurvedic Hospital, Uttarkashi in 2005; service of Ward Boys appointed in 2005, including petitioner’s husband was terminated by Director, Ayurveda, vide order dated 12/13-7-2007; the order of termination was challenged by such Ward Boys by filing writ petition, which was allowed and termination order was set aside; State filed appeals against the judgment rendered by learned Single Judge, which were dismissed and ultimately petitioner’s husband was reinstated in service as ward boy, on 16.08.2010. 4. Learned counsel for the petitioner submits that earlier, petitioner’s husband was posted in District Uttarkashi, however, he was subsequently transferred to District Chamoli in the year 2010. It is further her case that her husband went missing on 10.11.2015 and since his whereabouts were not known for more than seven years, therefore, petitioner filed a suit and learned Civil Judge (Senior Division), Chamoli vide judgment dated 13.2.2025 2025:UHC:9984 declared civil death of her husband. Learned counsel for the petitioner points out that Nagar Palika, Chamoli, ultimately issued death certificate regarding petitioner’s husband on 5.5.2025. 5. Grievance raised by the petitioner in this writ petition is that admissible dues pertaining to her husband have not been released to her. 6. Learned State Counsel, on instructions, however, submits that the amount of Group Insurance and Leave Encashment has already been paid to the petitioner; the pension papers were submitted to the Ayurveda Directorate on 17.10.2025 and the matter is pending before the respondent no. 2. He submits that family pension would be paid to the petitioner once sanction is granted by the Director. 7. Having regard to the facts and circumstances of the case, the writ petition is disposed of with a direction to respondent no. 2 to examine petitioner’s claim for family pension and pass necessary orders, within eight weeks from the date of presentation of certified copy of this order before him.
