The captioned Writ Petition is filed seeking a Writ of Certiorari to quash the proceedings initiated by respondents 2 and 3 in Notice No.117/SP/BC/NA.HA.JA.NI/2020 dated 04.01.2021 vide Annexure-K against the petitioner. 3. Counsel for the respective parties urged several contentions. Heard the contentions and perused the Writ papers with care. - 3 - NC: 2025:KHC:3866 WP No. 2586 of 2021 4. Suffice it to note that Sri.Yellappa - fourth respondent appears to have raised a complaint against the petitioner and two others contending that they have illegally constructed an apartment in land bearing Sy.No.25 situated at Kodichikkanahalli Village, Bengaluru. Based on the said complaint, the Police Sub Inspector, Civil Rights Enforcement, Bengaluru has initiated proceedings against the petitioner. The true copy of the communication is furnished along with the Writ Petition and the same is marked as Annexure-K. A perusal of the same reflects that Sri.Yellappa has some grievance about the land and he alleges that petitioner and two others have illegally constructed an apartment. The grievance of Sri.Yellappa is in civil nature. The Police authorities have no right to initiate proceedings with respect to land dispute. Hence, the impugned proceedings is liable to be quashed and so, it is quashed. 5. The Writ of Certiorari is ordered. The proceedings initiated by respondents 2 and 3 in No.117/SP/BC/NA.HA.JA.NI/2020 dated 04.01.2021 vide Annexure-K against the petitioner is quashed. - 4 - NC: 2025:KHC:3866 WP No. 2586 of 2021 6.
