This petition under Article 227 of the Constitution of India has been filed seeking following main relief (s) :- "(I). Issue an order or direction the Fast Track Court -Ist, Sultanpur to expedite the Session Trial No. 278 of 2023 (State Versus Kannojia) arising out of Case Crime No. 10 of 2023 under Sections Under Sections 376,420,452,506,406 of 1.P.C. relating to Police Station Dhammaur District Sultanpur, which is pending before the Fast Track Court -Ist, Sultanpur since the year 2023, expeditiously within the stipulated time period as this Hon'ble Court deem just and proper." Learned A.G.A., at the very outset, raised a preliminary objection stating that the petitioner has a remedy under Section 529 of the B.N.S.S., 2023. On being confronted, after taking note of the above, learned counsel for the petitioner states that he may be permitted to withdraw the writ petition with liberty to avail the remedy available. Accordingly, the writ petition is dismissed as withdrawn with the liberty as prayed for. Office is directed to return the certified copy of the papers, if any, to the learned counsel for the petitioner as per rules.
