The petitioner, who is the President of the Kumbakonam Division III & 2/9 https://www.mhc.tn.gov.in/judis W.P.(MD) No. 2071 of 2018 IV Employees & Public Service Co-operative Housing Society, is before this Court against the impugned order, dated 22.12.2017. 3. By the impugned order, the first respondent has directed the petitioner/society to allot Plot No.20 to the fourth respondent. It appears that the fourth respondent had earlier been allotted Plot No.37 by the petitioner. The said plot was irregular and corner plot and hence, the fourth respondent decided to approach the second respondent with the request to allot alternative plot. 4. By an order dated 23.11.2015, the second respondent directed the petitioner/society to allot one of the plots among Plot Nos.16, 17, 19, 20 and 152. However, no plot was allotted to the fourth respondent. Under these circumstances, Plot No.17 was allotted to the fourth respondent pursuant to the Revision Petition filed by the fourth respondent under Section 154 of the Tamil Nadu Co-operative Societies Act, 1983. Since the Plot No.17 was not allotted to the fourth respondent, he has, once again, approached the first respondent. The first respondent, thus, ordered to allot Plot No.20 to the fourth respondent. A reading of the impugned order passed by the first respondent indicates that there is no merit for its Review under Article 226 of the Constitution of India. 5/9 https://www.mhc.tn.gov.in/judis W.P.(MD) No. 2071 of 2018 There are no grounds to interfere with. The first respondent has correctly directed the petitioner to allot Plot No.20 to the fourth respondent. Therefore, this Writ Petition is liable to be dismissed. 6. The learned counsel for the petitioner has also produced a copy of the communication of the third respondent/society, dated 02.07.2025, wherein it has been confirmed that the Plot Nos.19, 20 and 37 are still vacant. Therefore, there can be no objection in allotting Plot No.20 to the fourth respondent. 7. Under these circumstances, the petitioner as also third respondent are directed to allot Plot No.20 to the fourth respondent within a period of two (2) weeks from the date of receipt of a copy of this order. 8. This Writ Petition is disposed of, with the above observations. No costs. Consequently, connected miscellaneous petition is closed.
